This document sets out the terms and conditions for using the pda.md website, administered by the "Democrația Acasă" Political Party (PDA). The website is informative, organisational, civic and political in nature and, where applicable, allows the submission of membership applications, communication with PDA, registration for activities and the making of donations under the conditions strictly provided by the legislation of the Republic of Moldova on political parties, political party financing, electoral campaign financing, personal data protection, political/electoral advertising, intellectual property and information security.
By accessing or using the website, the user confirms that they have read these Terms and accept the rules applicable to the use of the site. For operations that produce legal effects, including submitting membership applications, making donations, paying membership fees or registering as a volunteer, PDA may require express acceptance of the applicable version of the Terms, by ticking a separate box or by another clear affirmative action.
1. Website administrator
The pda.md website is administered by the "Democrația Acasă" Political Party (PDA), a political party registered under the legislation of the Republic of Moldova.

PDA may also publish on the website other official contact details, including the details of the special bank account intended for receiving financial contributions, donations and membership fees, under the conditions of Law no. 294/2007 on political parties and the acts of the Central Electoral Commission.
2. Object and purpose of the website
The website has an informative, organisational, civic and political purpose, within the limits provided by law. Through the website, PDA may:
publish information about the party, statute, programme, values, team, governing bodies, statements, public positions and current activities;
publish information about events, information campaigns, consultations, debates, civic initiatives and political activities;
provide forms for membership applications, contact, volunteering, event participation or communication with PDA;
allow donations or payment of membership fees, if these features are enabled and only in compliance with applicable legislation;
publish, during the electoral period, electoral information, campaign materials or communications of the electoral contestant, only within the limits permitted by the Electoral Code and the acts of the Central Electoral Commission.
During the electoral period, any content published on the site that constitutes electoral campaigning, electoral advertising, electoral material or financial/material support for the electoral campaign will be managed in accordance with Electoral Code no. 325/2022, the decisions of the Central Electoral Commission and the rules regarding the account marked "Electoral Fund". The publication of information on the site cannot be interpreted as authorisation of financing, material support, free provision of services, electoral promotion or collection of donations outside the legal framework.
3. General rules of use
By using the website, the user undertakes:
to provide correct, complete, current and truthful information in the forms on the site;
not to use the site for illegal, fraudulent, abusive purposes or in a manner likely to harm PDA, other users or third parties;
not to attempt unauthorised access to the systems, accounts, servers, databases or forms of the site;
not to introduce viruses, harmful programs, malicious code, bots, automated scripts or other mechanisms that may affect the security, availability or integrity of the site;
not to transmit through the site's forms illegal, offensive, defamatory, discriminatory, hate-inciting content or content that infringes the rights of others;
to respect intellectual property rights, the rules on personal data protection and electoral legislation;
not to use the site to create the appearance of financial, material, logistical or electoral support that does not correspond to reality or that is not declared in accordance with the law.
PDA reserves the right to limit, block or restrict access to the site or to certain features in the event of abusive, illegal, fraudulent use or use not in compliance with these Terms, without prejudice to PDA's right to notify the competent authorities.
4. Prohibited content
It is prohibited to use the site for:
direct or indirect financing of PDA, an electoral contestant, an initiative group or an electoral campaign outside the conditions provided by law;
making donations on behalf of third parties, through intermediaries, false identities, bank accounts that do not belong to the donor or from financial means that do not come from the donor's own legal income;
proposing or offering PDA free services, goods, works, advertising space, logistical support, transport, accommodation, printing, online promotion, media production, consultancy or other benefits that may constitute donations, indirect financing or undeclared material support;
transmitting content that incites hatred, discrimination, violence, separatism, undermining of the constitutional order, defamation of the state or the people, war of aggression or other manifestations prohibited by law;
reproducing, promoting or using the attributes of political parties declared unconstitutional, of prohibited entities or of symbols whose use is prohibited by law;
illegally collecting, transmitting or publishing the personal data of other persons;
using bots, fake accounts, artificial traffic manipulation, spam, coordinated inauthentic campaigns or other technical methods of distorting public communication.
5. Intellectual property
The entire content of the website, including texts, logos, symbols, images, graphic elements, video materials, structure, design, names and visual identification elements, belongs to PDA or is used on the basis of a legal right of use. Reproduction, distribution, modification, adaptation, republication or use of the content for commercial, electoral or political purposes by third parties is permitted only with the prior written consent of PDA, except in cases permitted by law.
Quoting fragments for information, press, analysis, research or public debate purposes is permitted, indicating the source pda.md and without distorting the meaning of the quoted material.
Where certain materials published on the site are used under third-party licences, PDA will comply with the conditions of the applicable licence, including the obligation of attribution, indication of source, maintenance of copyright notices or other conditions of use.
6. Membership applications
The site may allow the submission of a membership application to PDA. Submitting the application through the site does not automatically confer PDA membership. Membership is acquired only under the conditions of Law no. 294/2007, the PDA statute and the decision of the competent party body.
The person applying for membership declares, as applicable, that they are a citizen of the Republic of Moldova, have the right to vote, are not a member of another political party and are not in a legal situation that prohibits participation in political activities. PDA may request additional information and documents strictly necessary to verify the legal and statutory membership conditions.
The rights and obligations of a PDA member arise only from the date the person is entered in the party membership register, in accordance with the law and the PDA statute. PDA keeps the party membership register, updates it continuously and submits the relevant information to the Central Electoral Commission and the Public Services Agency within the deadlines and forms established by them.
7. Donations to PDA
The site may allow donations in support of PDA's activity only under the conditions of Law no. 294/2007 on political parties, Electoral Code no. 325/2022, the acts of the Central Electoral Commission, financial-accounting, tax, banking legislation and personal data protection legislation.
Through the site, PDA may accept donations only after identifying the donor, confirming the mandatory declarations and minimal verification of legal conditions. PDA reserves the right and has the obligation to refuse, return, block, report or transfer to the state budget any amount received in violation of the law, in accordance with applicable legal procedures.
Making a donation does not confer special rights on the donor within the party, does not create political obligations on PDA, cannot condition the party's decisions and cannot aim to limit PDA's independence.
7.1. Donations accepted through the site
Through the website, PDA accepts donations only from natural persons who cumulatively declare that they: are citizens of the Republic of Moldova; are 18 years of age; are not under judicial protection in the form of guardianship; donate in their own name, from their own financial means and legal income; the donation is not made on behalf of, at the instruction of, with the money of or in the interest of a third party; the donation does not come from social aid, prohibited sources, illicit external financing or means whose origin cannot be justified; the donated amount, cumulated with other donations and fees to one or more political parties in the same budget year, does not exceed the legal ceilings; they are aware that information regarding the donation may be reflected in PDA's financial reports and may be communicated to the Central Electoral Commission, under the law.
7.2. Persons and entities that cannot finance PDA
It is prohibited to finance, provide free services or materially support, in any form, directly or indirectly, PDA by: citizens of the Republic of Moldova under 18 years of age; citizens subject to a judicial protection measure in the form of guardianship; foreign citizens; stateless persons; anonymous persons; persons donating on behalf of third parties; public authorities, organisations, enterprises, public institutions or other legal entities financed from the public budget or with state capital, except in cases expressly provided by law; legal entities that, at the date of the donation, have debts to the state budget, the state social insurance budget or the mandatory health insurance funds; legal entities that, in the last 3 years, have concluded public procurement contracts for works, goods or services within the meaning of Law no. 131/2015 on public procurement; legal entities with foreign or mixed capital; legal entities from abroad; other states and international organisations, including international political organisations; non-commercial, trade union, charitable or religious organisations; any other persons or entities prohibited by law from financing, providing free services or materially supporting political parties.
7.3. Donation ceilings
Donations are accepted only within the ceilings established by law:
a natural person may donate to one or more political parties, in a budget year, at most the equivalent of 6 average monthly salaries in the economy established for that year;
the total amount donated cannot exceed 30% of the donor's annual income, recorded for the previous calendar year;
if the donor is a person holding a public dignity office, a civil servant, including with special status, or an employee of a public organisation within the meaning of the legislation on the declaration of assets and personal interests, the amount of donations cannot exceed 10% of their annual income and, in any case, cannot exceed the ceiling of 6 average monthly salaries in the economy;
if the donor receives only scholarships or other social benefits, the donation ceiling cannot exceed one average monthly salary in the economy for that year;
if the donor is a member of PDA or another party, the membership fees paid in the same year are included in the annual legal ceiling, being reflected separately in the accounting records and financial reports.
For 2026, at an average monthly salary in the economy of 17,400 lei, the general ceiling of 6 average monthly salaries is 104,400 lei, and the ceiling for cash donations is 17,400 lei. These values are updated annually according to the average monthly salary in the economy established for that year.
7.4. Method of donation
Donations through the site are made only by bank card or bank transfer, with identification of the donor in the bank document. Through the site, PDA does not accept anonymous donations, donations through instruments that do not allow identification of the donor, donations made through intermediaries or donations from accounts that do not belong to the donor.
Cash donations are not made through the site. Cash donations may be accepted only at PDA's headquarters or offices, within legal limits, with the signing of a sworn statement in the form approved by the Central Electoral Commission, with the issuance of supporting documents and with the deposit of the amount into the party's special bank account, in accordance with applicable legal and accounting procedures.
In a budget year, the cash donations of a natural person to one or more political parties cannot exceed one average monthly salary in the economy established for that year. Donations exceeding this limit are made exclusively through banking operations.

Payment description: Donation / membership fee, as applicable, indicating the donor's first and last name.
7.5. Mandatory declarations before donating
Before completing the donation, the donor must confirm the following declarations, which may be included in the electronic donation form: that they are a citizen of the Republic of Moldova; are 18 years of age; are not under judicial protection in the form of guardianship; donate in their own name, from their own financial means; the donation is not made on behalf of or with the money of another person; the donated money comes from legal income other than social aid; the donated amount, cumulated with other donations and fees paid in the current year to one or more political parties, does not exceed the legal ceilings; they do not act as an intermediary for a natural or legal person, foreign state, international organisation, non-commercial, trade union, religious, charitable organisation or other entity prohibited by law from financing political parties; they accept that PDA may refuse, return, report or transfer the donation to the state budget if there are suspicions or findings of legal violations; they have read the Privacy Policy and acknowledge that donation data may be reported to the Central Electoral Commission and published within the limits provided by law.
7.6. Donations from legal entities
PDA does not accept automatic donations from legal entities through the online form. Any donation intention from a legal entity is examined individually, before acceptance, with verification of the conditions provided by law, including the existence of the decision of the competent body of the legal entity, the absence of legal prohibitions, compliance with the annual ceiling, accounting reflection and the absence of incompatible situations, including public financing, state capital, foreign or mixed capital, budget debts or public procurement contracts in the cases provided by law.
PDA may refuse any donation from a legal entity when it cannot sufficiently verify compliance with legal conditions.
7.7. Donors located abroad
Citizens of the Republic of Moldova temporarily or permanently abroad may make donations only if they meet all the legal conditions applicable to natural person donors, donate in their own name, from their own legal income, in compliance with the annual ceilings and through banking instruments that allow identification of the donor.
PDA does not accept anonymous donations, donations through intermediaries, donations from accounts that do not allow identification of the donor, donations made on behalf of third parties, donations from foreign legal entities, international organisations, foreign states, non-commercial, religious, trade union, charitable organisations or other entities prohibited by law. PDA does not open or use bank accounts abroad for collecting donations.
7.8. Non-compliant donations, refusal, return and reporting
PDA may refuse or block the processing of a donation if there are indications that the donation comes from a prohibited source, exceeds the legal ceilings, is made through intermediaries, is anonymous, does not allow identification of the donor, comes from unjustified financial means or may constitute illegal direct or indirect financing.
Amounts received in violation of legal provisions or the part of donations exceeding the legal ceilings will be managed in accordance with applicable legislation, including by return, reporting to the competent authorities or transfer to the state budget, as appropriate. PDA cooperates with the Central Electoral Commission and other competent public institutions to verify the legality of donations.
8. Membership fees
Membership fees are paid in the amount and manner provided by the PDA statute and the internal procedure approved by the competent party body, in compliance with Law no. 294/2007 and the acts of the Central Electoral Commission.
Fees may be paid through banking operations or in cash, under the law. When collecting the fee in cash, a supporting document is issued, and the amount is transferred to the party's special bank account within the legal deadline. Information about fee-paying members is transmitted to the Central Electoral Commission within the deadline and format established by its acts.
If a party member also makes donations in the same year, the fee and the donation are reflected separately in the accounting and financial management reports, but are taken into account cumulatively when verifying the legal ceiling applicable to the natural person.
9. Electoral campaign financing and the "Electoral Fund" account
During the electoral period, any donations, payments, services, goods, works, advertising, online promotion, electoral materials, technical expenses or other contributions intended for the electoral campaign are made only in compliance with the Electoral Code, the decisions of the Central Electoral Commission and, where applicable, through the bank account marked "Electoral Fund".
PDA does not accept or use in the electoral campaign financial means, goods, services, works, logistical support, advertising, online promotion or other contributions that are not reflected in the financial records and campaign reports. During the electoral period, any electoral promotion expense through the site, social networks, digital platforms, video production, design, printing, SMS, e-mail, IT services or advertising is made only on the basis of supporting documents and from sources permitted by law.
PDA does not use financial means outside the account marked "Electoral Fund", does not use undeclared funds or materials, does not exceed the general ceiling established by the Central Electoral Commission and does not benefit from goods or services for consideration without advance payment when the law imposes this condition.
10. Electoral campaigning and political/electoral advertising
During the electoral period, any material published on the site that constitutes electoral campaigning or electoral advertising will be published only during the period permitted by the Electoral Code and only in compliance with the requirements regarding financing, marking, recording and reporting of electoral expenses.
PDA does not publish or distribute, in electoral programmes, electoral campaigning materials, campaigning actions or electoral advertising, images representing religious cults or their components, foreign officials, foreign state institutions or public authorities, international organisations or attributes of political parties declared unconstitutional.
Responsibility for the content of advertising electoral materials broadcast or published by PDA belongs to PDA, the electoral contestant or the referendum participant, as appropriate. Advertising materials will comply with the requirements of the Electoral Code, advertising legislation and the decisions of the Central Electoral Commission.
The site will not be used to publish appeals, statements or actions to disseminate information for electoral purposes outside the periods and conditions permitted by law.
11. Prohibition of gifts, aid and benefits
PDA does not use the site to organise acts of charity, sponsorship, distribution of consumer or essential goods, offering money, food products, alcoholic beverages, tobacco products, services, gifts, prizes, benefits, humanitarian aid or other material benefits to voters, supporters, members or other persons.
During the electoral period, any use of the site to offer, promise, promote or distribute material or non-material benefits in order to induce a voter or supporter to exercise or not exercise their electoral rights is prohibited.
12. Volunteering and non-monetary contributions
Persons who wish to support PDA through volunteering may do so only under the conditions of the legislation on volunteering and PDA's internal procedures.
Activities performed for PDA on a voluntary basis under the law are not considered donations. However, free services, goods, works, logistical support, advertising, media production, transport, accommodation, equipment, consultancy or other contributions offered free of charge or below market value may constitute donations or material support and may require evaluation, accounting records and reporting to the Central Electoral Commission.
PDA may refuse any offer of volunteering, free service or material contribution where there is a risk of indirect financing, external financing, disguised donation, conflict of interest, lack of supporting documents or impossibility of evaluation and reporting.
13. Financial reporting, audit and cooperation with authorities
PDA keeps records of donations, fees, contributions, expenses and supporting documents in accordance with financial-accounting legislation, Law no. 294/2007, the Electoral Code and the acts of the Central Electoral Commission.
PDA cooperates with the Central Electoral Commission, the Court of Accounts, the State Tax Service, licensed banks, auditors, courts and other competent authorities, within the limits provided by law.
PDA may request from donors, fee payers, volunteers, suppliers or other persons additional documents and information to verify compliance with the legislation on the financing of political parties and electoral campaigns. Failure to provide the requested information may result in refusal of the donation, suspension of processing, return of the amount or reporting of the situation to the competent authorities.
14. Personal data protection
Personal data collected through the site is processed in accordance with PDA's Privacy Policy, which forms an integral part of these Terms. In the case of membership applications, donations, fees, volunteering and political communications, the data may reveal political opinions and is processed with appropriate safeguards.
Data on donors and fee payers may be transmitted to the Central Electoral Commission, the State Tax Service, banks, auditors, the Court of Accounts, courts or other competent authorities, within the limits provided by law. Information from the financial reports of parties, with the exceptions expressly provided by law for data such as IDNP, date and month of birth, domicile or temporary residence, may be published on the page of the Central Electoral Commission and, where applicable, on PDA's website.
The user must not transmit through the site's forms personal data of other persons without a legal basis or without their consent. PDA may delete, restrict or refuse the processing of excessive, irrelevant information or information transmitted in violation of the law.
15. Third-party links
The site may contain links to external pages, social media platforms, public institutions, payment providers or other sites administered by third parties. The inclusion of a link does not represent approval, support, assumption of liability or guarantee of the content, policies, practices or security of third-party sites. Users should consult the terms, privacy policies and rules of third-party platforms before using them.
16. Limitation of liability
The site is provided within the limits of reasonable technical availability. PDA makes efforts to keep the information correct and up to date, but does not guarantee that the site will function without interruptions, technical errors or incompatibilities with all devices, browsers or systems of users.
No provision of these Terms limits or excludes PDA's liability for the obligations provided by law regarding the financing of political parties, the financing of electoral campaigns, reporting to the Central Electoral Commission, personal data protection, intellectual property, political/electoral advertising or other mandatory legal obligations.
PDA is not liable for the content of third-party sites to which links may exist, but the inclusion of a link does not represent support, validation or assumption of liability for the content, policies or practices of third parties.
17. Website security
PDA may implement technical and organisational measures to protect the site against unauthorised access, cyber attacks, abusive use, data loss, unauthorised modification, unauthorised disclosure or other security incidents.
Users are obliged not to test, scan, bypass or compromise the security of the site and not to use the site for activities that may affect the technical infrastructure of PDA or its providers. Any incident, vulnerability or suspicion of unauthorised use may be communicated to PDA at the contact address indicated in Section 1.
18. Changes to the terms
PDA may modify these Terms to reflect legislative, technical, organisational or operational changes to the site. The updated version will be published on the site, indicating the date of the last update.
Continued use of the site after the publication of the changes constitutes acceptance of the updated version of the Terms. For operations that produce legal effects, PDA may require express acceptance of the applicable version of the Terms.
19. Applicable law and dispute resolution
These Terms are governed by the legislation of the Republic of Moldova. Any disagreement related to the use of the site will be resolved, as far as possible, amicably. In the absence of an amicable solution, disputes will be resolved by the competent courts of the Republic of Moldova, in compliance with the applicable rules of jurisdiction.
20. Final provisions
If a provision of these Terms is declared null, invalid or inapplicable, the other provisions remain applicable, to the extent permitted by law.
In the event of a conflict between these Terms and a mandatory legal rule, the mandatory legal rule applies. In the event of a conflict between these Terms and a special procedure published on the site for donations, fees, volunteering or electoral campaign, the rule that provides the higher level of legal compliance and transparency applies.
